honestly i am/was not very much into 'street protest' idea. I believe Malaysia is far more civilized for that.

BUT NOW

Learning from the change of tide in my malaysia, i bow to the reality, 'SOMETIMES WE HAVE TO CHANGE THE TUNE WHEN THERE IS A NEED"

Talking about street protests and demos, we rarely get to see MIC(BN) in ACTION, as they always give priorities to round table or closed door discussions to get(try) things solved. So the leaders TALK and we(RAKYAT) enjoys/ suffers the outcome.

This 'style' caused them alot in GE-12. The oppositions managed to spin it and the rakyats were infected by amnesia. Opposition's OPEN STYLE seems more attractive and most importantly gave a feel of PARTICIPATION for the rakyat.

THE RAKYAT ALWAYS RIGHT

The tide changed. They want everything to be transparent. they want be a part of it.

A good political party should walk in a style preferred by rakyat. Since GE-12 MIC via their youth wing become very vocal.

And, this is their walk in protest against temple demolition.

About 100 MIC members demonstrated here to protest the demolition of a Hindu temple by the Ampang Jaya Municipal council recently.

The crowd, which included Indian NGOs, protested at the main gate of the Selangor secretariat building yesterday morning.

Organiser T. Mohan, who is MIC Youth chief, said the PKR government had lied to the people that they would not tear down any places of worship.

“They said no temples would be destroyed, what happened now?” Mohan told reporters the MIC was unhappy with the state government’s action to demolish the Sri Mahakaliaman temple after he presented a memorandum to Mentri Besar Tan Sri Khalid Ibrahim’s political secretary, Nik Nazmi Nik Ahmad.

The 19-year-old temple was built on forest reserve. It was destroyed and rebuilt several times between 2002 and 2007.

Asked why the MIC did not solve the issue then, Mohan said the party had taken action and that was why the temple was rebuilt.

I know some will choose to ask, 'where were they in the past, when so many hindu temples demolished nationwide'. A respond from the MIC nation youth coordinator :

“There are so many temples without permit, that is a fact, we know it, but you (the state government) have promised not tear down any temples.

“I can tell you 50% to 60% of temples in the country don’t have proper permits and the (temple) committees may have not have been registered too, but that doesn’t mean you can tear down their temples,” he said.

MIC had always fought against the demolition of temples, citing as an example the party’s protest to former Mentri Besar Datuk Seri Dr Mohd Khir Toyo when seven or eight temples in Puchong were demolished, including a controversial one in Padang Jawa, just before the March 8 general election.

Now, like many i am hoping for a solution for this matter for good. Not only from BN but also from PR who is in power in 5 states.

Dont just shut / close this with 'words' . I think indians who voted for PR in selangor are not going to buy it anymore.

The Selangor state government should not repeat the mistake done by the former Selangor government, who had in my view, ignored the plea of the Indian community in demolishing temples. That government, especially the then Menteri Besar totally disregarded the views of the community, MIC included. They suffered the backlash at the March general election.

Now Pakatan is going the same way. The MB has not even commented on the issue. Is it because of fear that the government might face backlash from the Malay community for speaking for Hindus?

HINDRAF is shocked with the statement made by Dr.Xavier Jayakumar which appears to echo that of the usual excuses given by BN and UMNO leaders that Temples are demolished because they are not “registered”.

We challenge Dr Jayakumar and his Pakatan Government to produce the necessary provisions of the state Law that stipulated the necessity of the so-called “format”. To add insult to injury he had the audacity to say this is not a Temple but a shrine. Is he trying to indicate that it was okay to demolish a shrine? How less is a shrine than a temple?? The problem with these politicians is they do not give a dam about the feelings of

Hindus and the need to provide and gazette places of worships belonging to Hindus.

HINDRAF have specifically written to the 5 Pakatan led Governments to gazette all temples (which is directly under their purview) but till date they have not taken any positive steps to do the same and keep misleading the people in the same way BN did.

Temples in draft plan will not be demolished

ALL Hindu temples on government land situated in commercial zones in the Draft Kuala Lumpur City Plan 2020 would not be demolished, Deputy Federal Territories Minister Datuk M. Saravanan said.

He said if temples situated on government land were affected by development projects undertaken by the Government, they would be given an alternative site for relocation, reported Malaysia Nanban.

He added that prior approval from City Hall was required for new temples to be built, even on private land.

Speaking to reporters on Friday after meeting representatives of the Malaysian Hindu Council over the draft, Saravanan said the ministry would allow the various communities to build their houses of worship in housing estates.

There was a news posted at Hindraf's website on a Recent temple demolishing in selangor BY PAKATAN RAKYAT who championed the temple issue during GE-12. ( a very well staged drama to win indian's vote) ( Ref: Ulu langat temple demolished) ( REF :Bah Humbug!)

According to the post ( with photo's), the temple committee was approached by "pakatan rakyat ppl" and shamelessly requested or shall i say begged them not to inform this issue to the people.

The malaysian indians denied MIC forever? that is a very subjective question. But more then 50% of them voted against it during GE-12. thats a fact. That caused MIC to loose their power/voice in almost all the state governments and it is forced to keep things rolling with only 3 parliament members and 3 cabinet reps.

Can they perform with much reduced power, representatives and support? Especially now, when the demands from rakyat is in the peak. Many predicted that MIC is yesterdays news.

Despite all the rotten eggs that have been thrown at them, MIC managed to survive. MIC is still on track to walk for the rakyat!!! and thats a fact!!!

The immediate/effective responds from MIC in all the current issues shows that MIC CARES even after many claims that Indian community rejected them. and thats a fact!!!

The number of people seeking assist at MIC HQ and MIC service centers nationwide increased . And thats a fact!!! ( Ref: Indian folk back to seek help, says Samy )

while all this happening, many equipped/CURSED with ONLY POLITICAL INTEREST choose to confuse the rakyat against MIC.

MIC's success with weak students

KUALA LUMPUR: An MIC effort to help academically-weak and problematic Indian secondary students has paid off.

The MIC-run Yayasan Strategic Social's family development unit head K.A. Gunah (picture) said the party's Plus-8 programme had proven to be a resounding success by helping 5,100 students in 74 secondary schools.

PETALING JAYA: The MIC has reiterated its call for the Government to free five Hindraf leaders from Internal Security Act (ISA) detention.

Party president Datuk Seri S. Samy Vellu said that he would raise the matter with Prime Minister Datuk Seri Abdullah Ahmad Badawi again, despite having done so many times.

SEPTEMBER 16 had come and gone. Datuk Seri Anwar Ibrahim failed to unseat Datuk Seri Abdullah Ahmad Badawi as the Prime Minister.

As a Muslim, Anwar should accept that he can plan, but God decides.

From the very beginning what he did was morally wrong, although politics by a Machiavelian standard is apolitical.

It may be the accepted norms in other developing countries, but Malaysia has come of age and our politicians should show maturity and dignity when clamouring for political power.

Anwar should have the patience to wait for the next general election and let the people decide. He already has control over five states and should concentrate on them by showing to the people how the Opposition governs these states.

In a democracy it is the people who actually hold and wield power and not the politicians. For in the words of Abraham Lincon, “democracy is government by the people, of the people and for the people.”

On March 8, the people decided to cut Barisan Nasional’s two-third majority and yet BN accepted the defeat graciously and respected the will of the people.

When Anwar won in the Permatang Pauh by-election, it was again an indication of the people’s will and again BN accepted it in good faith.

Instead of being arrogant, Anwar should be humble with his victory in Permatang Pauh. Buying over BN representatives runs counter to his anti-corruption campaign.

A man of virtue will not resort to unethical means to meet his objectives and he has indeed lost the respect of certain quarters.

As a member of the public, I call on Anwar to close ranks and work together in the interest of the country.

As a former Deputy Prime Minister and Umno strongman, he has access to Pak Lah and can contribute in terms of ideas etc.

As the Opposition Leader, he can play a constructive role by bringing up pressing issues which affect the rakyat directly.

What the people need is less politicking as there are many urgent matters affecting them, such as illegal immigrants, spiralling food prices, wayward youths, the education system, etc.etc.

I was in the Ministry of Foreign Affairs for a short stint when Pak Lah was the Minister. I had the opportunity to study him at close range.

In all honesty, Pak Lah is a God-fearing man, hardworking, humble and well-liked by civil servants. I believe he never yearned to be the Prime Minister. Tun Dr Mahathir probably saw the good values in Pak Lah and passed the premiership to him to the surprise of some hopefuls.

Being the Prime Minister is not as easy as being a Deputy Prime Minister.

Indeed, heavy is the head that wears the crown,as Pak lah has probably found out.

But as he said at a press conference, ”... being Prime Minister is not main-main and olok-olok..it is serious business...”

I believe Pak Lah is a man of his word. When the time comes he will honour his words and pass the baton to his annointed successor Datuk Seri Najib Tun Razak.

Meanwhile, let Pak Lah do his job in peace.

So it is september 18 now. Still no sign of PR to form a new government. While DSAI still claiming that he have the numbers ( i dont think PR need numbers YB, you need real people to form the government) , all the barisan component parties took this "sept 16 failure" as a chance to brand DSAI as pembohong. well, thats politics.......

Like many, i am more interested to know what DSAI's DAP and PAS friends got to say. I wonder if he had showed them "the list" .

An interesting statement from DAP's YB Kulasegaran on this defection issue.

The DAP prefers fresh elections than defections to decide on the new government.

Its national vice-chairman M. Kulasegaran said this has always been the stand of the party which was fair to the voters.

“This is because elected representatives who won in elections under their party banners should stand by them,” he told reporters after a vigil outside the Ipoh Barat DAP office on Tuesday evening.

Few months ago, i have posted an article on DAP's views ( source NST) on defection issue

DAP, PKR and Pas have agreed on many issues, including forming Pakatan Rakyat, but political crossovers are still very much a bone of contention among them.

While PKR big guns have been boasting of a hijrah or exodus of elected representatives from Barisan Nasional to Pakatan, DAP has been less receptive about the entire notion.

DAP chairman Karpal Singh has gone on record as saying that he was dead set against it, even asserting that he would break ranks with the opposition coalition and side with BN a motion for an anti-hopping law.

DAP has traditionally been against what it calls "political kangaroos".

Back in 1978, party adviser Lim Kit Siang delivered a stirring speech when moving a motion to introduce a private member's Bill for the prevention of defection.
But this is no surprise considering that this party had been battered by office bearers who quit the DAP for either MCA or Gerakan over the years.

Yap Pian Hon (now Datuk) was among the most prominent DAP stalwarts who crossed to the MCA.

In 1969, he won a seat in Parliament on a DAP ticket, but moved to the MCA five years later and he retained the seat continuously until the last election when he was dropped -- an extremely long wait for DAP to see "justice".

It was particularly painful for DAP to bear, since Yap quickly rose up the MCA ranks to become arguably one of the most popular chiefs of the Youth wing for championing the communal cause and moved on to the vice presidency.

Another former stalwart, the late Datuk Richard Ho, defected in 1972 and had a meteoric rise in MCA rising to become deputy president and a federal minister a few short years later.

From then on, various DAP leaders have deserted the party throughout the decades.

The more recent high profile crossovers included that of Lee Yuen Fong (more popularly known as Tiger Lee), and state vice-chairman Lim Fui Ming last year which triggered a media war between himself and DAP leaders.

But with PKR's de facto leader Datuk Seri Anwar Ibrahim buoyant about having at least 30 Barisan MPs in the bag ready to cross over, most likely to PKR, to form the federal government, will DAP be squeezed into a minor role?

Political analyst Khoo Kay Peng believes so and that DAP's main concern is of being marginalised if PKR does end up being the giant in the tripartite grouping.

"Their fear is that they may turn into the next Gerakan, a party which had no clout within BN, with governing power only in Penang," he said.

With Anwar setting his sights on Bumiputera MPs in Sabah and Sarawak including current Umno leaders, Khoo said it may decrease DAP's ability to reach out to the non-Chinese.

"In that worst-case scenario, with PKR becoming another Umno, exerting its power and dominance over other parties, DAP could possibly leave the coalition and strike out on its own as an opposition," said Khoo.

While DAP leaders have not gone to the extent of voicing this possibility, the party seems to be in a split between idealism and politics.

Karpal did not mince his words when he said he would be sticking to his guns on the issue, even if Pakatan Rakyat did form the federal government.

"In fact, I do not want any part in this Pakatan Rakyat Government this way.

"Parties who form Government through crossovers will be looked upon negatively. The party would be full of traitors."

This view is also shared by several other young party leaders, perhaps being idealists who don't want the DAP to be "corrupted" by party-hoppers who want to bet on a winning horse.

However, party supremo Lim Kit Siang has been curiously coy over the issue.

When contacted, he refused to comment, and asked that the views of other party leaders be sought instead.

Is the DAP head honcho, the anti-hopping firebrand that he was 30 years ago, finally having a change of heart?

A well-versed party insider, who declined to be named, said he just might sing a different tune, what with the possibility of the DAP having a part in forming the Government within its grasp.

DS Anwar I , The next prime minister of malaysia??? . I remembered a statement from Tun Dr. M on that few days ago. He said, "Anwar will never become PM, If he does, I'll migrate from malaysia". mmmm..... no comments....

"Self proclaimed prime minister in waiting" , thats how malaysiakini refers DSAI in its reports. What is DSAI's real motive? Can i say "only god knows"...

Whatever it is, he made is point clear "I WANT TO BE THE PM OF MALAYSIA" . Let me rephrase it " RAKYAT MALAYSIA, I PROMISE YOU A NEW MALAYSIA 'IF' I BECOME THE NEXT PM".

Is DSAI the only guy in PR who can deliver this "New Malaysia" ? He was once the NO.1 enemy of DAP and PAS, and now......... :) . They united under him and gave him the mandate to lead them. ( atleast thats what i thought).

"The sept 16" , one of the main factor wich holding up PR's loose coalition. We can see, they choose to put aside their diff for now because of this. If anwar fails, he'll be branded as PEMBOHONG NOMBOR SATU NEGARA and his DAP, PAS 'friends' may loose trust on his leadership. If he managed to perform this miracle, then he better be ready to face a quandary , especially from PAS's YB Hadi.

Malaysiakini described the ISA arrests as BN's "own goal" in their match against anwar's sept 16 plan.

Today, the De facto Law Minister Datuk Zaid Ibrahim has submitted his resignation letter to the Prime Minister. ( Ref : Law Minister Zaid 'tenders resignation')

The 3 ISA arrests ( especially 2 of it) condemned by almost everyone. I even came across a news on BN and BR in penang passing a draft resolution condemning the arrest of three people under the Internal Security Act on Friday.

MIC Bayan Baru division chairman M. Nyana Segaran was the only person from a Barisan Nasional component party who attended the 45-minute meeting at the residence of Chief Minister Lim Guan Eng here last night.

“I’m only representing my division and not the party,” he told newsmen after the meeting. ( ref :Parties pass resolution blasting ISA)


Ministers and party leaders within Barisan Nasional have lashed out at Friday’s ISA arrests. Some have gone as far as to call for the Act to be comprehensively reviewed, while others maintained that the draconian law is still relevant but should never be abused or used against civilians.

Human Resources Minister Datuk Dr S. Subramaniam (MIC)

said the Government should be sensitive to the feelings of the people and not be blind to the fact that a significant proportion of the rakyat abhor the ISA and would prefer it not to be used.

“Every time somebody is arrested under the ISA, it gives rise to a perception that the Government is doing it because it is not able to charge and convict the person under existing laws,” he said.


Foreign Minister Datuk Seri Dr Rais Yatim ( UMNO)
said some aspects of the ISA ought to be subjected to intermittent review but its function to prevent occurrences that divide the community should be respected.


Health Minister Datuk Liow Tiong Lai (MCA)
called for the ISA to be reviewed so that it would not be abused by any quarters to undermine national unity, security and stability.

There should be new laws to govern racial relations, encourage greater unity and avoid discrimination among races in the country.

“The Race Relations Act I’m proposing should be looked into by the Unity, Arts, Cultural and Heritage Ministry,” he said.


Gerakan acting president Tan Sri Dr Koh Tsu Koon ( Gerakan)

said Gerakan had called for the amendment of the ISA but not its abolition.

He said the Act should be used only when dealing with national security and not against journalists carrying out their duties.


MCA president Datuk Seri Ong Ka Ting

said MCA felt that if the ISA was really necessary, it must only be invoked in the most extreme cases.

Otherwise, he said, the Act would be a threat to the rule of law and the fundamental liberties as enshrined in the Constitution.

“In fact, even the drafter of the ISA, the late Prof R.H. Hickling, had said the Act was only intended against communist insurgents and those bent on armed struggle.

“If at all national security is threatened, there must be strong evidence to show that. Otherwise, such detainees should be charged in an ordinary court of law and there are sufficient laws for this purpose,” he said.


Well, like many, i am still waiting for YAB Pak Lah's statement on this. Did the police or home minister acted on his advice?

Tindakan polis menahan tiga individu di bawah Akta Keselamatan Dalam Negeri (ISA) semalam dilakukan secara profesional tanpa campur tangan politik.

Current situation, Their days are numbered , thats what barisan rakyat ( YB DSAI) has been saying on BN since GE-12. The BN government is no longer being loved as much as they used to be by rakyat.

This ISA arrests can be used as a tool to topple the government by BR. It can be used to hike the hatred of rakyat on BN. It can even be used to create quandary among BN component parties. powerful backlash from Rakyat.

Despite this major risks, the home minister made a very bold move to use ISA on 3 ( prominent bloger, media and a opp MP) .

Hopefully you understand my point of view from this quote.

Also, 99.9% percent of the all governments worldwide including USA / UK / SINGAPORE / CHINA / JAPAN / INDIA have their own versions of ISA ( Terrorism Act / Tada at etc ). Does that mean it's a weak government?

For nation's stability some harsh decisions must be made. Spare the rod , spoil the child.

I am not saying we need to use because everybody uses. We use it because we need to use it. Something like cutting of a gangrene in order to save the body*to quote Tun Dr M*. Some harsh methods have to be done in order to have stability in the system.

The rakyat had voiced out their dissatisfaction in this issue.... So The Home Minister should be transparent on the evidence that 'forced' him to use ISA. Lets see if it can undo/ mend this backlash.

Gerakan calls for ISA to be amended or abolished

Gerakan acting present Tan Sri Dr Koh Tsu Koon has called on the government to either amend or abolish the Internal Security Act.

He said the existence of the act painted a very negative perception of the country to the outside world, adding that it was also irrelevant considering the country had a sound judicial system in place.

“It is time this act be seriously looked at. Gerakan strongly urges the government to abolish the ISA once and for all.

“There is no reason why anyone should be subject to the provisions of this act which simply means detention without trial when the authorities can use the judicial system instead,” he said after opening the state Gerakan convention here.

Koh said the judicial system was far more transparent in terms of the legal and social aspects as compared to the ISA.

PRESS STATEMENT FROM MIC PRESIDENT

KUALA LUMPUR: MIC president Datuk Seri S. Samy Vellu on Saturday appealed to the Government to release Sin Chew Daily News reporter Tan Hoon Cheng who was arrested under the Internal Security Act (ISA) on Friday.

In a statement Saturday, he said he would ask Home Minister Datuk Seri Syed Hamid Albar to immediately release Tan.

He said by doing so certain elements will not blame the Government for curtailing press freedom.

Samy Vellu added that Tan is a young reporter and only reported what was said. Therefore he appealed to Prime Minister Datuk Seri Abdullah Ahmad Badawi to release her.

Try RPK and Teresa Kok under court of law, not ISA

Transparency International Malaysia (TI-M) today urged the government to immediately release prominent blogger Raja Petra Kamaruddin and Seputeh MP Teresa Kok who have been detained under the Internal Security Act (ISA).

TI-M president Tan Sri Dr Ramon V. Navaratnam said the government should charge the individuals who allegedly violated laws in an open court, instead of flexing its muscles through the ISA as it would negate much of the country's progress.

He said the act had eroded efforts in promoting transparency, acountability and freedom of speech in the country.

"This retrograde action will be severely criticised by most fair-minded Malaysians and foreigners, and is a major blow to the more liberal policy of the country," he told Bernama here.

Besides Raja Petra and Kok, Sin Chew daily reporter Tan Hoon Cheng was also arrested yesterday for allegedly sparking racial tensions.
However, Tan was released at 2.30pm today.

Raja Petra, 58, who was arrested under Section 73(1) of the ISA, is alleged to have posted articles deemed seditious and that also belittle Islam.

Last week, the Department of Islamic Development (Jakim) and several Muslim organisations lodged a police report against him for allegedly insulting Malays, Muslims and Islam.

On Sept 6, under The Corridors of Power article posted on Malaysia Today, Raja Petra had hinted that it might be his last article until Sept 16, if he were to be detained under the ISA. He is banking on Anwar’s Sept 16 promise for an early release from ISA.

“Yes, I too have placed not only my money, but also my freedom on Anwar. And if Anwar fails to deliver his promise on Sept 16, not only he but I as well am headed for a fall,” he said in his posting.

Sin Chew Daily reporter Tan Hoon Cheng is believed to have been arrested over her report on former Bukit Bendera Umno division chief Datuk Ahmad Ismail’s racist remarks while campaigning for the Permatang Pauh by-election last month.

YB Kok

DAP’s Seputeh MP Teresa Kok is also assemblyman for Kinrara and a senior executive councillor in charge of investment, industry and trade.

Kok, 43, is believed to have been picked up in connection with a residents petition in Puchong over a mosque.

Former mentri besar Datuk Seri Dr Mohd Khir Toyo had allegedly accused Kok of being involved.

She subsequently denied the allegation and demanded an apology from Dr Mohd Khir and the newspaper which reported it.

The allegations are serious. Any kind of action that effects unity and racial stability, especially during bulan puasa entitled for immediate action. ( If they are true)
But Why ISA?? Why Not Sedition act?

REFERRING TO THE CASES ABOVE, THEY DESERVE A TRANSPARENT TRIAL. AND IT SHOULD BE DONE AT ONCE!!!

INTERNAL SECURITY ACT

Relevant sections of the legislation are as follows:

Section 73(1) Internal Security Act 1960: "Any police officer may without warrant arrest and detain pending enquiries any person in respect of whom he has reason to believe that there are grounds which would justify his detention under section 8; and that he has acted or is about to act or is likely to act in any manner prejudicial to the security of Malaysia or any part thereof or to maintenance of essential services therein or to the economic life thereof."

Section 8 ISA: Power to order detention or restriction of persons. "(i) If the Minister is satisfied that the detention of any person is necessary with a view to preventing him from acting in any manner prejudicial to the security of Malaysia or any part thereof or to the maintenance of essential services therein or the economic life thereof, he may make an order (hereinafter referred to as a detention order) directing that that person be detained for any period not exceeding two years."

A detenu can make representations against his/her detention if an order of detention has been made against the detenu by the Minister under Section 8(1) of the ISA but under Section 73 however, the detenu seems to have no such right. Generally, the attitude of the Malaysian courts in respect of detention under Section 73 is that the courts have jurisdiction only in regard to any question on compliance with the procedural requirements of the ISA and they seldom grant any substantive rights to the detenu. SEDITION ACT

Section 4 of the Sedition Act specifies that anyone who "does or attempts to do, or makes any preparation to do, or conspires with any person to do" an act with seditious tendency, such as uttering seditious words, or printing, publishing or importing seditious literature, is guilty of sedition. It is also a crime to possess a seditious publication without a "lawful excuse". The act defines sedition itself as anything which "when applied or used in respect of any act, speech, words, publication or other thing qualifies the act, speech, words, publication or other thing as having a seditious tendency".

Under section 3(1), those acts defined as having a seditious tendency are acts with a tendency:

(a) to bring into hatred or contempt or to excite disaffection against any Ruler or against any Government;

(b) to excite the subjects of the Ruler or the inhabitants of any territory governed by any government to attempt to procure in the territory of the Ruler or governed by the Government, the alteration, otherwise than by lawful means, of any matter as by law established;

(c) to bring into hatred or contempt or to excite disaffection against the administration of justice in Malaysia or in any State;

(d) to raise discontent or disaffection amongst the subjects of the Yang di-Pertuan Agong or of the Ruler of any State or amongst the inhabitants of Malaysia or of any State;

(e) to promote feelings of ill-will and hostility between different races or classes of the population of Malaysia; or

(f) to question any matter, right, status, position, privilege, sovereignty or prerogative established or protected by the provisions of part III of the Federal constitution or Article 152, 153 or 181 of the Federal Constitution.

Section 3(2) provides certain exceptions, providing examples of speech which cannot be deemed seditious. It is not seditious to "show that any Ruler has been misled or mistaken in any of his measures", nor is it seditious "to point out errors or defects in the Government or Constitution as by law established". It is also not seditious "to attempt to procure by lawful means the alteration of any matter in the territory of such Government as by law established" or "to point out, with a view to their removal, any matters producing or having a tendency to produce feelings of ill-will and enmity between different races or classes of the population of the Federation". However, the act explicitly states that any matter covered by subsection (1)(f), namely those matters pertaining to the Malaysian social contract, cannot have these exceptions applied to it.

Section 3(3) goes on to state that "the intention of the person charged at the time he did or attempted (a seditious act) ... shall be deemed to be irrelevant if in fact the act had, or would, if done, have had, or the words, publication or thing had a seditious tendency". This latter provision has been criticised for overruling mens rea, a legal principle stating that a person cannot be guilty of a crime if he did not have the intent to commit a crime.[1]

A person found guilty of sedition may be sentenced to three years in jail, a RM5,000 fine, or both.

Year 1987, i 1st set foot on my beloved school. A school not much bigger then a 3/4 of a football field. Student enrollment about 500.

It was a temple hall actually ( Sri maha mariamman temple, PD). A school with a big student enrollment stuffed in a temple hall.

Year 1991, DSSV paid a visit to my school. He promised us a new building and land.

1993, My UPSR year. Dato seri Samy vellu walked his talk. We got a new land and new building. From a temple hall to a school, the size of 3 1/2 football field. In PD town.

From what i heard then ( i was only 11 years) MIC funded the land and the building.

Just felt like sharing this story that happened 15 years ago. Its still fresh in my mind, the 1st time i realized whats the true meaning of MIC for our community.

MIC, Malaysian Indian Congress, the symbol of malaysian indian unity. Thats what we used to hear , at least till last year. For most of malaysian indians, MIC was their true champion at least untill 2004 .Now, MIC is a 'punch bag' for many. Anything wrong with the community blame it on MIC!!!???

Now its time for a more transparent MIC. The rakyat wants to know whats happening. The rakyat choose to keep track on their walks.

May we firstly congratulate your goodself and your party in winning the 12th General Election held on 8/03/2008.

As your goodselves have acknowledged the winds of change and the past mistakes, may we humbly propose that your goodselves form the Truth and Reconciliation Commission with regards to the very sad state of affairs, discrimination and maginalisation of especially the 80% Malaysian Indian poor. With the sincere formation of this commission we hope to move
forward and grow together from now onwards in the True spirit of oneness, and equality and equal opportunity for all the poor especially the Malaysian Indian poor and mostly importantly
humanity. The Malaysian Indians have persistently complained about the following:

(11) Hindu Temples are indiscriminately demolished at the rate of one Hindu Temple in every three weeks

I consider HINDRAF as the voice of malaysian indian community( a part). 17 demands/ complaints . Here i would like to highlight 1 of it. The demolishing of Hindu temples. And it is the responsibility of MIC to accept this complaint and resolve it. And this time the rakyat wants to see a open approach, a transparent walk.

Temples in draft plan will not be demolished

ALL Hindu temples on government land situated in commercial zones in the Draft Kuala Lumpur City Plan 2020 would not be demolished, Deputy Federal Territories Minister Datuk M. Saravanan said.

He said if temples situated on government land were affected by development projects undertaken by the Government, they would be given an alternative site for relocation, reported Malaysia Nanban.

He added that prior approval from City Hall was required for new temples to be built, even on private land.

Speaking to reporters on Friday after meeting representatives of the Malaysian Hindu Council over the draft, Saravanan said the ministry would allow the various communities to build their houses of worship in housing estates.

“If you want to help sincerely, come and talk to the relevant authorities instead of using the media and the blogs to create hype,” Saravanan said.

He said this in the wake of articles published on the allegations of 120 temples missing from the Draft Kuala Lumpur City Plan 2020.

“I challenge these people who make allegations to come up with the list of the missing temples. (Ref :Saravanan: Don’t use religious issues for political gain)
So, FT MIC walking their talk on 'temple issue'. So, for once lets put aside our differences (political) and focus on community and nation interest.

I hope to see such progress nationwide on this issue. And it is only possible if all of us acknowledge and support their moves.

Whats the update on 'The Racist Teacher"..........

The teacher who allegedly made racist remarks has been transferred to the Selangor Education Department, holding a new position in which she does not deal with students.

She has also undergone a two-week counselling session on the importance of national unity.

As to whether she would be teaching again, Deputy Education Minister Datuk Dr Wee Ka Siong was non-committal.

"It depends on the assessment of her counsellors. So far, the reports I've received are good."

She is expected to be transferred out of the state Education Department and Selangor altogether, but Wee refused to divulge her next destination.
